Terms of Service
fork.me subdomains. The apps belong to you. Their
contents, behaviour, and consequences also belong to you. We provide the road and the
road signs — you drive.
1. Acceptance of these Terms
These Terms of Service (the "Terms") form a binding agreement between
you ("you", "User") and FORK Apps, Inc.
("Fork", "we", "us"), a Delaware
corporation. They govern your access to and use of fork.me, any
*.fork.me subdomain, our APIs, our CLI, our mobile clients, and any
related service (collectively, the "Service").
By creating an account, signing in, calling our APIs, or accessing any app hosted on the Service, you accept these Terms and our Privacy Policy. If you do not agree, do not use the Service.
If you use the Service on behalf of a company or other entity, you represent that you have authority to bind that entity, and "you" means both you and that entity.
2. What Fork is
Fork is an AI-assisted platform for building and hosting web applications. You
describe what you want; our AI agents generate source files; the Service stores those
files in our virtual filesystem and serves them to end users at URLs we control,
including fork.me/{handle}/{slug} and
{app-id}.fork.me/{version}/.
We are an infrastructure provider, not the author or publisher of the apps you create. We do not pre-screen, review, endorse, or curate user-generated content. The apps you build are your speech and your product. We host and serve them on your behalf.
3. Eligibility & Accounts
You must be at least 13 years old to use the Service, and at least 18 (or the age of majority in your jurisdiction) to purchase a paid subscription. By using the Service you confirm you meet these requirements and that you are not located in, ordinarily resident in, or a national of any country subject to a comprehensive U.S. embargo, and you are not on any U.S. government list of prohibited or restricted parties.
You are responsible for the security of your account credentials, API keys, and access tokens. Notify us at abuse@co.fork.me immediately if you suspect unauthorised access.
One human, one account, unless we explicitly allow otherwise (e.g. organisation accounts). Sharing credentials, automating account creation, or evading bans is not allowed.
4. Your Apps & Your Responsibility
"User Content" means everything you put into the Service or that the Service produces on your behalf — your prompts, conversation history, generated source files, images, datasets, app names, descriptions, custom domains, and anything your apps display or transmit to end users.
4.1 Ownership stays with you
You own your User Content, including any source code that our AI agents generate in response to your prompts. We claim no equity, no royalty, and no copyright in your apps. You can take your code with you (export, CLI clone, manual download).
4.2 You grant us the rights we need to host it
To run the Service, you grant Fork a worldwide, non-exclusive, royalty-free, sublicensable licence to host, store, copy, transmit, render, format, display, modify (strictly for technical purposes such as compression, transcoding, or sub-domain serving), and otherwise process User Content. This licence exists only so that we can operate the Service and ends when you delete the content (subject to backups and reasonable retention windows).
4.3 You are responsible for everything your app does
- Legality. Your app must comply with all laws applicable to you and to your end users — including consumer protection, advertising, gambling, financial services, healthcare, export control, and tax law.
- Intellectual property. You must have the rights to every asset you upload or have your app reproduce — text, images, code, logos, audio, video, fonts, datasets. Generated code that re-implements someone else's protected expression is your problem, not ours.
- Privacy & data protection. If your app collects personal data from end users, you are the data controller. You must publish a privacy policy that complies with GDPR, CCPA/CPRA, COPPA, and any other regime that applies to your users, and you must obtain valid consent where required.
- Disclosures. If your app displays AI-generated content, advertising, sponsored placements, or paid promotion, you must disclose that clearly per applicable law.
- Security of end-user data. You must protect any data your app collects with industry-standard measures and respond to breaches as the law requires.
- Accuracy. You are responsible for the truthfulness of any claims your app makes — especially health, financial, legal, or safety claims.
If a third party — an end user, a regulator, a rights-holder — comes to Fork with a complaint about your app, we will treat that complaint as a complaint about your conduct. See Indemnification.
5. AI-Generated Output
Fork uses third-party large language models (currently Anthropic's Claude family and others) to generate code and text on your behalf. We do not warrant that AI output is accurate, complete, secure, fit for any purpose, original, non-infringing, or consistent. Output may overlap with output produced for other users with similar prompts; we make no claim of exclusivity.
You are the author of record of any app you publish via Fork. You decide what to keep, edit, or discard. You are responsible for testing — including for security vulnerabilities, race conditions, data-handling correctness, and accessibility — before you make an app available to end users.
Some upstream model providers prohibit certain inputs (for example, real personal data of third parties without consent, or attempts to reproduce copyrighted training data verbatim). Their rules pass through to you when you use Fork.
6. Hosting & Distribution
We assign each of your apps a stable identifier and host it under
{app-id}.fork.me and at fork.me/{handle}/{slug}. We may add,
change, or retire URL formats with reasonable notice. You can request a new URL or
point your own custom domain at the Service if and when we offer that feature.
We use commercially reasonable measures to keep your app reachable. We may cache, replicate, compress, or rewrite responses for performance, security, or compliance. We may rate-limit, captcha, or temporarily suspend any app that creates abuse risk (e.g. mass-mailing, DDoS amplification, malware delivery, or sustained API abuse) — with notice when practical, immediately when not.
We may display attribution (for example, a small "Built with Fork" badge or
X-Powered-By header) on apps served from fork.me
subdomains. We do not insert advertising into your app without your consent.
7. Prohibited Content & Conduct
You may not use the Service, and you may not build, host, distribute, or link to an app via the Service, that does any of the following — whether by your direct action or by the action of an end user you knowingly enable:
- Violates any law or regulation, or any rights of any person or entity.
- Infringes copyright, trademark, patent, trade secret, publicity, or privacy rights, including by re-distributing pirated content.
- Produces, hosts, or distributes child sexual abuse material (CSAM) — we report CSAM to NCMEC and applicable authorities and preserve all legally required evidence.
- Promotes, glorifies, or facilitates terrorism, mass violence, self-harm, trafficking, or the sexual exploitation of any person.
- Targets a person or group with harassment, threats, doxxing, or non-consensual intimate imagery.
- Distributes malware, ransomware, spyware, stalkerware, cryptojackers, or any code intended to compromise systems or data without authorisation.
- Conducts phishing, credential harvesting, deceptive impersonation, or fraud (including investment scams, romance scams, fake-charity schemes).
- Sends unsolicited bulk communications (spam) of any kind, by any channel.
- Scrapes, mirrors, or re-publishes the Service or other users' apps without permission.
- Probes, scans, stress-tests, reverse-engineers, or attempts to bypass our quotas, rate limits, or security controls.
- Uses the Service to train, fine-tune, or distil a competing model or coding agent.
- Resells or sublicenses raw access to the Service, except as expressly allowed by a separate written agreement with us.
We may judge your activity by its effect, not just your intent. If your app is indistinguishable from one of the patterns above, we will treat it as one of them.
8. Subscriptions, Tokens & Refunds
The Service is offered in a free tier and in paid plans (currently Prompter, Developer, and Pro). Paid plans renew monthly until you cancel. Prices are listed at sign-up and may change with at least 30 days' notice for renewals.
On the web we process payments through Stripe; on iOS, through Apple's in-app purchase system. By subscribing you accept the applicable processor's terms in addition to these.
Subscriptions include a monthly bonus of generation tokens. Tokens are consumed by AI agent calls (chat with the manager and builder, image generation, etc.). Tokens do not roll over and have no cash value, are non-transferable, and are not redeemable for refund or substitute. Unused tokens are forfeited on cancellation, downgrade, or termination.
Refunds. Web (Stripe) subscriptions are non-refundable except where required by law. iOS subscriptions follow Apple's refund policy and must be requested through Apple. Cancellation stops future renewals; it does not refund the current period.
We may suspend or terminate access to paid features for non-payment, chargebacks, or payment-method fraud.
9. Takedown, Reports & DMCA
Anyone — registered or not — may report an app or a user for violating these Terms. We review reports on a best-effort basis and may take action up to and including removing the app, freezing the account, and notifying authorities.
Copyright (DMCA). If you believe your copyrighted work has been copied to an app on Fork in a way that constitutes infringement, send a notice to dmca@co.fork.me containing:
- your physical or electronic signature;
- identification of the copyrighted work claimed to be infringed;
- identification of the material on the Service to be removed (URLs);
- your address, phone number, and email address;
- a statement that you have a good-faith belief the use is not authorised; and
- a statement, under penalty of perjury, that the information is accurate and that you are authorised to act on behalf of the rights-holder.
We will respond to valid notices in accordance with the U.S. Digital Millennium Copyright Act, including by removing or disabling access to the allegedly infringing material and notifying the affected user. Our designated agent is reachable at the address above. We terminate the accounts of repeat infringers.
Counter-notices and other abuse complaints follow the same channel: abuse@co.fork.me.
10. Data & Privacy
How we collect, use, and share information about you and your end users is described in our Privacy Policy, which forms part of these Terms.
For data that your app collects from your end users, you are the controller and we are at most a processor on your behalf. You must provide your end users with a privacy notice and a lawful basis for processing.
11. Availability & No SLA
We do not promise the Service will always be up, fast, or error-free. There is no uptime SLA on free or self-serve paid plans. We may take the Service offline for maintenance, security patching, or emergency response. We will try to give notice for planned downtime; we cannot for unplanned outages.
We may change, deprecate, or remove features at any time. We will give reasonable notice for material changes that affect paid plans.
12. Disclaimers
The Service, the AI output, and any apps hosted on the Service are provided "AS IS" and "AS AVAILABLE", without warranty of any kind, whether express, implied, statutory, or otherwise. Fork specifically disclaims all warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, quiet enjoyment, and any warranties arising from course of dealing or usage of trade.
We do not warrant that the Service will meet your requirements, that AI output will be correct or non-infringing, that the Service will be uninterrupted, secure, or free of viruses or other harmful components, or that any defect will be corrected.
Some jurisdictions do not allow the exclusion of certain warranties; in those jurisdictions, the above exclusions apply only to the extent permitted by law.
13. Limitation of Liability
To the maximum extent permitted by law, Fork's total aggregate liability to you arising out of or relating to the Service or these Terms is limited to the greater of (a) the amount you paid Fork in the twelve (12) months preceding the event giving rise to the claim and (b) one hundred U.S. dollars (US$100).
In no event will Fork, its officers, employees, agents, or affiliates be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including lost profits, lost revenue, lost data, business interruption, or cost of substitute services, even if advised of the possibility of such damages and even if a remedy fails of its essential purpose.
Some jurisdictions do not allow the limitation of incidental or consequential damages; in those jurisdictions, the above limitations apply only to the extent permitted by law.
14. Indemnification
You will defend, indemnify, and hold harmless Fork and its officers, employees, agents, and affiliates from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to:
- your User Content, including any app you build, publish, or host on the Service;
- your use of the Service in violation of these Terms or any applicable law;
- your violation of any third-party right, including intellectual-property, publicity, or privacy rights; or
- any dispute between you and an end user of an app you operate.
We will give you prompt notice of any such claim, may participate in defence at our own expense, and will not settle a claim that imposes liability on you without your written consent (not unreasonably withheld).
15. Termination
You can stop using the Service at any time. Cancel a subscription
from the account page (web) or in your Apple ID's subscription settings (iOS), and
delete your account at /settings. We will delete your User Content
within a reasonable window, subject to backups, fraud-prevention retention, and
legal-hold obligations.
We can stop providing the Service to you if you breach these Terms, create legal or security risk for us or other users, or — with reasonable notice — for any other reason. We may suspend an account or app immediately and without prior notice for serious violations (illegal content, security threats, payment fraud, etc.).
Sections that by their nature should survive termination (e.g. ownership, licence, disclaimers, limitation of liability, indemnification, governing law, miscellaneous) survive.
16. Changes to These Terms
We may update these Terms. If we make material changes we will give notice — by email, in-app banner, or notice on this page — at least 14 days before they take effect. Continued use of the Service after the effective date means you accept the updated Terms. If you don't, stop using the Service before the effective date.
17. Governing Law & Disputes
These Terms are governed by the laws of the State of Delaware, USA, without regard to its conflict-of-laws rules. The exclusive venue for any dispute arising under these Terms is the state and federal courts located in Delaware, and you consent to personal jurisdiction there.
Any cause of action you may have arising out of or relating to the Service must be commenced within one (1) year after the cause of action accrues; otherwise, it is permanently barred.
If any provision of these Terms is held unenforceable, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.
