End User License Agreement
1. The Agreement
This End User License Agreement (the "EULA") is a binding agreement between you ("you", the "End-User") and FORK Apps, Inc. ("Fork", "we", "us"), a Delaware corporation, governing your use of the Fork software application and any updates, components, documentation, and content delivered with it (collectively, the "Licensed Application").
The Licensed Application is licensed, not sold, to you for use only under the terms of this EULA. By downloading, installing, or using the Licensed Application, you agree to be bound by this EULA. If you do not agree, do not download, install, or use the Licensed Application.
This EULA is concluded between you and Fork only, and not with Apple Inc. ("Apple") or any other application marketplace operator. Fork — not Apple or the marketplace — is solely responsible for the Licensed Application and its content. Where you obtained the Licensed Application through the Apple App Store, your use is also subject to Apple's App Store Terms of Service and Usage Rules.
Your use of the Fork platform itself — the AI agents, the virtual filesystem, hosting
apps under fork.me subdomains, and everything you build — is governed by
our Terms of Service and Privacy Policy,
which are incorporated into this EULA by reference. In the event of a conflict between
this EULA and the Terms of Service with respect to your built apps and account, the
Terms of Service control.
2. Scope of License
Fork grants you a limited, non-transferable, non-exclusive, revocable license to install and use the Licensed Application on any Apple-branded products (or, for non-Apple builds, any device) that you own or control, and as permitted by the Usage Rules of the marketplace from which you obtained it. You may use the Licensed Application on any devices you own or control, subject to those Usage Rules and to family-sharing or volume-purchase arrangements where applicable.
Except as expressly permitted by this EULA, by the applicable Usage Rules, or by law, you may not:
- distribute or make the Licensed Application available over a network where it could be used by multiple devices at the same time;
- rent, lease, lend, sell, redistribute, sublicense, or transfer the Licensed Application;
- copy (except as expressly permitted), decompile, reverse-engineer, disassemble, or attempt to derive the source code of the Licensed Application, except to the extent such restriction is prohibited by applicable law or permitted by the licensing terms governing any open-source components included with it;
- modify, create derivative works of, or remove, alter, or obscure any proprietary notices (including trademark and copyright notices) in the Licensed Application.
If you sell or transfer the device on which the Licensed Application is installed, you must first remove the Licensed Application from it. Fork reserves all rights in and to the Licensed Application not expressly granted to you under this EULA.
3. Consent to Use of Data
You agree that Fork may collect and use technical data and related information — including but not limited to technical information about your device, system and application software, and peripherals — that is gathered periodically to facilitate the provision of software updates, product support, and other services to you (if any) related to the Licensed Application.
Fork may use this information, as long as it is in a form that does not personally identify you, to improve its products or to provide services or technologies to you. How we handle information about you is described in our Privacy Policy.
4. Maintenance & Support
Fork is solely responsible for providing any maintenance and support services with respect to the Licensed Application, as specified in this EULA or as required under applicable law. You and Fork acknowledge that Apple has no obligation whatsoever to furnish any maintenance and support services with respect to the Licensed Application.

5. Warranty
Fork is solely responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed.
Any other claims, losses, liabilities, damages, costs, or expenses attributable to any failure to conform to any warranty will be the sole responsibility of Fork, as between Fork and Apple. See the disclaimer below for the warranties Fork disclaims.
6. Product Claims
Fork, and not Apple, is responsible for addressing any claims by you or any third party relating to the Licensed Application or your possession and/or use of it, including but not limited to:
- product liability claims;
- any claim that the Licensed Application fails to conform to any applicable legal or regulatory requirement;
- claims arising under consumer protection, privacy, or similar legislation, including in connection with the Licensed Application's use of frameworks for processing of data; and
- claims that the Licensed Application or your use of it infringes a third party's intellectual property rights.
This EULA does not limit Fork's liability to you beyond what is permitted by applicable law.
7. Intellectual Property Rights
In the event of any third-party claim that the Licensed Application or your possession and use of it infringes that third party's intellectual property rights, Fork, and not Apple, will be solely responsible for the investigation, defense, settlement, and discharge of any such intellectual property infringement claim.
The Licensed Application, and all intellectual property rights in it, are and remain the property of Fork and its licensors. Apps you create with Fork remain yours, as described in our Terms of Service; this section concerns the Licensed Application itself, not your User Content.
8. External Services
The Licensed Application may enable access to Fork's and third parties' services and websites (collectively and individually, "External Services") — for example, AI model providers, payment processors, and the apps you host on the Fork platform. You agree to use the External Services at your sole risk.
Fork is not responsible for examining or evaluating the content or accuracy of any third-party External Services, and shall not be liable for any such third-party External Services. Data displayed by any Licensed Application or External Service, including AI-generated output, is provided for general informational purposes only and is not guaranteed by Fork. You will not use the External Services in any manner that is inconsistent with this EULA or the Terms of Service, or that infringes the intellectual property rights of Fork or any third party, and you will not use the External Services to harass, abuse, stalk, threaten, or defame any person or entity.
Fork reserves the right to change, suspend, remove, disable, or impose access restrictions or limits on any External Services at any time without notice or liability to you.
9. No Warranty (Disclaimer)
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, USE OF THE LICENSED APPLICATION IS AT YOUR SOLE RISK, AND THE ENTIRE RISK AS TO SATISFACTORY QUALITY, PERFORMANCE, ACCURACY, AND EFFORT IS WITH YOU.
The Licensed Application and any services performed or provided by it are provided "AS IS" and "AS AVAILABLE," with all faults and without warranty of any kind. Fork and its licensors hereby disclaim all warranties and conditions with respect to the Licensed Application, whether express, implied, or statutory, including the implied warranties and/or conditions of merchantability, satisfactory quality, fitness for a particular purpose, accuracy, quiet enjoyment, and non-infringement of third-party rights.
Fork does not warrant against interference with your enjoyment of the Licensed Application, that the functions contained in it will meet your requirements, that its operation will be uninterrupted or error-free, or that defects will be corrected. No oral or written information or advice given by Fork or its authorized representative shall create a warranty. Some jurisdictions do not allow the exclusion of implied warranties, so the above exclusion may not apply to you.
10. Limitation of Liability
To the extent not prohibited by law, in no event will Fork be liable for personal injury or any incidental, special, indirect, or consequential damages whatsoever, including damages for loss of profits, loss of data, business interruption, or any other commercial damages or losses, arising out of or related to your use of or inability to use the Licensed Application, however caused, regardless of the theory of liability (contract, tort, or otherwise), and even if Fork has been advised of the possibility of such damages.
To the maximum extent permitted by law, Fork's total aggregate liability to you for all damages arising out of or relating to the Licensed Application is limited to the greater of (a) the amount you paid Fork for the Licensed Application or associated subscription in the twelve (12) months preceding the event giving rise to the claim and (b) fifty U.S. dollars (US$50).
Some jurisdictions do not allow the limitation of liability for personal injury or of incidental or consequential damages, so this limitation may not apply to you.
11. Legal Compliance & Export
You represent and warrant that:
- you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a "terrorist supporting" country; and
- you are not listed on any U.S. Government list of prohibited or restricted parties.
You agree to comply with all applicable U.S. and other export and re-export control laws and regulations. You will not use the Licensed Application for any purpose prohibited by applicable law, including the development, design, manufacture, or production of nuclear, missile, chemical, or biological weapons.
12. Third-Party Terms
You must comply with applicable third-party terms of agreement when using the Licensed Application. For example, you must not be in violation of your wireless data service agreement when using the Licensed Application, and you must comply with the terms of any third-party services (such as AI model providers and payment processors) that the Licensed Application uses on your behalf.
13. Apple as Third-Party Beneficiary
This section applies where you obtained the Licensed Application through the Apple App Store. It does not give Apple any obligation under this EULA, and does not make Apple responsible for the Licensed Application or its content.
14. Termination
This EULA is effective until terminated by you or Fork. Your rights under this EULA will terminate automatically, without notice, if you fail to comply with any of its terms.
Upon termination, you must cease all use of the Licensed Application and delete all copies, in whole or in part, from your devices. Sections that by their nature should survive termination — including Scope of License restrictions, Intellectual Property, Disclaimer, Limitation of Liability, Legal Compliance, Apple Third-Party Beneficiary, Governing Law, and General — survive.
15. Governing Law
Except to the extent expressly provided otherwise, this EULA and your use of the Licensed Application are governed by the laws of the State of Delaware, USA, excluding its conflict-of-laws rules, with venue in the state and federal courts located in Delaware. Your use may also be subject to other local, state, national, or international laws.
If you are a citizen of any European Union country, or of Switzerland, Norway, or Iceland, the governing law and forum shall be the laws and courts of your usual place of residence. The United Nations Convention on Contracts for the International Sale of Goods does not apply to this EULA.
16. General
This EULA, together with our Terms of Service and Privacy Policy, constitutes the entire agreement between you and Fork regarding the Licensed Application and supersedes all prior understandings on that subject. We may update this EULA from time to time; if we make material changes, we will provide notice as described in our Terms of Service, and your continued use of the Licensed Application after the effective date constitutes acceptance.
If any provision of this EULA is held to be unenforceable, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect. Fork's failure to enforce any right or provision will not be deemed a waiver of it.
